These Terms and Conditions govern your use of the Lex Advice Group website and any services provided by Lex Advice Group. By requesting our services, sending documents, attending an appointment, making payment, or using this website, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
Scope of Services
Lex Advice Group provides professional McKenzie Friend services together with practical legal support, document preparation and case assistance. We are not a firm of solicitors and do not provide regulated legal services unless expressly permitted by law.
Basis of Instruction
By asking Lex Advice Group to undertake work, sending documents, attending an appointment, or making payment, you confirm that you accept these Terms and Conditions.
Scope of Work
We will only carry out work that has been agreed with you. Any work requested outside the agreed scope may incur additional charges, which will be discussed with you before the work is undertaken where reasonably possible.
Client Responsibilities
You remain responsible for your own case, documents, court deadlines, filings, statements, evidence, conduct and decisions throughout your matter. You are responsible for checking all documents carefully before they are submitted, filed, served or otherwise relied upon.
Accuracy of Information
You must provide complete, honest and accurate information at all times. We are entitled to rely upon the information and documentation you provide and cannot accept responsibility for errors, omissions or delays resulting from inaccurate or incomplete instructions.
Document Preparation
Draft documents are prepared using the instructions and information you provide. It is your responsibility to approve the final version before it is filed, served, sent to another party or used within any legal proceedings.
Court Attendance
Where court attendance has been arranged, attendance is provided as a McKenzie Friend unless the court grants any additional permission.
Rights of Audience
Lex Advice Group does not have automatic rights of audience. Any permission for us to address the court or otherwise participate in proceedings remains entirely at the discretion of the Judge.
Conduct of Litigation
We do not conduct litigation and do not act as your solicitor on record.
No Guarantee of Outcome
Whilst every effort is made to provide professional support, we cannot guarantee the outcome of any matter, court application, judicial decision, settlement, costs recovery or timescale.
Refusal or Termination of Services
We reserve the right to refuse instructions or cease acting on your behalf where there is non-payment, abusive or threatening behaviour, dishonesty, a conflict of interest, unreasonable instructions, safeguarding concerns, or any other circumstance which makes continued involvement inappropriate.
Third Parties
We are not responsible for the actions, advice, delays or decisions of courts, solicitors, barristers, experts, government departments, process servers, mediators, opposing parties or any other third party.
Safeguarding
We may disclose information where required by law or where we reasonably believe disclosure is necessary to protect a child, vulnerable person, yourself, our staff, or any other person from harm.
Working with Parallel Lives Programme CIC
Where appropriate, you agree that Lex Advice Group may share relevant personal information, case documents, updates and communications with Parallel Lives Programme CIC where reasonably necessary for case support, referrals, safeguarding, collaborative working, administrative purposes or services connected with your matter.
Confidentiality
We will treat your information confidentially except where disclosure is required by law, authorised by you, necessary for the delivery of our services, or justified by safeguarding or serious risk concerns.
Limitation of Liability
To the fullest extent permitted by law, Lex Advice Group shall not be liable for any indirect or consequential loss, loss of opportunity, loss of chance, judicial outcome, financial loss arising from court decisions, or losses resulting from inaccurate instructions, incomplete information or delays outside our reasonable control.
Liability Cap
Our total liability for any claim arising from the services provided shall not exceed the fees paid by you for the specific service giving rise to that claim.
